#AskALawyer Show 15: Can You Beat a Speeding Ticket with the Wrong Citation?
This week's question is all about traffic tickets. Specifically, a client wants to know what one can do when the cop cites you for the wrong thing. Here's a great example: Let's say you are driving on the highway. You are driving too fast - 65 in a 60 mph zone. The cop pulls you over and gives you a ticket. You go and look the ticket up, though, and realize that he cited you for driving too fast for conditions, which doesn't really apply in this situation. Can you beat a speeding ticket in that scenario? Watch the video to find out! Traffic Lawyer Secrets: Why Do I Give Them Away?
I do a show every week called The #AskALawyer Show. In that show, I invite people to ask me questions about anything they want. This week's question was about traffic tickets. Specifically, a listener wanted to know why a traffic lawyer, like myself, would want to give away my secrets for beating traffic tickets again and again. I thought it was a great questions, so I took a couple of minutes and answered it. Enjoy! Is Speeding Ticket Mitigation the Right Choice?
One of the frequently asked questions we get here at Emerald City Law Group is if speeding ticket mitigation is the right choice. Today I want to answer that question with an emphatic no! Three Reasons Speeding Ticket Mitigation is Not the Answer It's easy for me to just tell you no, without any explanation, right? But that's not how we do it here. I don't want to just tell you why it's a bad choice, I want you to know why it's a bad choice. We're not just about getting paid here. We're more than happy to hand out some free advice from time to time. 1. You Still Have to Go to Court This may or may not be a problem for you, but if I wasn't a traffic attorney, taking the time to go to court in the middle of the day to ask for a $50 discount would be a colossal waste of time for me. Let's assume you make $20/hour. If it takes you an hour to get to court, an hour for court to take place, and an hour to get back, then you've already paid more than if you just paid the ticket (3 hours of lost vacation time). Factor in gas and the hassle and you're losing more by contesting than not. 2. Speeding Ticket Mitigation Requires Groveling I don't know about you, but the last thing I want to do is get up in front of some judge and explain to them why I was driving too fast. And the worst thing is I'd probably have to come up with some lame excuse. There is nothing I hate more than having to tell someone I did something wrong that I don't think is wrong and then throw myself at their mercy. I don't think you should have to do that either. 3. Your Car Insurance is Still Affected This is probably the number one reason why speeding ticket mitigation is not the right choice. When you mitigate your ticket you are admitting to speeding. When the judge reduces the fine you are found to have been speeding. That information is reported to the Department of Licensing who then reports it to your insurance company, who then raises your rates. What Should You do if You get a Speeding Ticket? The obvious answer is to call us for help - 206.973.0407. We can answer your questions, learn about your situation, and help you decide what the best course of action is for you. At the end of the day, don't mitigate. There are better options. Christopher Small is the co-owner of Emerald City Law Group. He gets a kick out of beating speeding tickets. He figures you

What Not to Say to the Cops When Stopped for Speeding
In this episode of The Ultimate Traffic Lawyer Podcast I talk about what to say to the cops when you get stopped for speeding. This does not happen too often, but it happens enough that it warrants a podcast episode. What usually happens when you get pulled over by the cops for speeding? They ask you for your license and insurance and then they ask you “do you know why I stopped you.” This episode is all about answering that specific question. In this Episode I Talk About: How not to dig yourself a big hole when stopped for speeding; When to be nice to the cops, and when to be difficult; The one thing you can do to help me, your traffic lawyer, beat your ticket; and An old school method that I use. How to Avoid a Cell Phone Ticket
In this episode of The Ultimate Traffic Lawyer Podcast I talk how to avoid a cell phone ticket. Last week my wife got a cell phone ticket. I’ve told her time and time again that she needs to figure out a hands free solution to her driving and cell phone talking. She wasn’t that concerned about options until after getting the ticket. Amazing what a little $124 ticket can do. So I thought I’d talk about her options, and yours, here, so maybe you can avoid the same fate she did. In this Episode I Talk About: The dangers of talking on your cell phone and driving; A hands free option that lets you use your speakers to talk and listen; A hands free option that works in and out of the car; An old school method that I use; and How to avoid a cell phone ticket. We Don’t Want You in Court for Your Contested Hearing
In this episode of The Ultimate Traffic Lawyer Podcast I talk about why your notice of contested hearing for your traffic ticket tells you that you must come to court even though we tell you that you don’t have to go. Every day our clients call us with the same question: “why does their notice of contested traffic ticket hearing tell them they have to come to court if they don’t really have to?” We get this question so often that we have a form email we send out when we get notices for our clients for their hearings! I thought today I’d solidify the answer on this podcast, so if you all out there have this question then you can have it answered (just in case your traffic lawyer won’t get back to you). In this Episode I Talk About: The process for having a contested traffic hearing; What your notice of contested hearing will tell you; Why, if you hire us to be your traffic attorney, you don’t have to go to court; and Much much more! Why We Beat so Many Speeding Tickets
In this episode of The Ultimate Traffic Lawyer Podcast I talk how we are able to beat so many speeding tickets. You’ll hear about this on the podcast, but this year we’ve only lost one traffic ticket. Yes, you heard that right. But that success doesn’t just happen by accident. It happens because of the specific way we approach traffic ticket defense. It involves a lot of time and effort, and it involves a system we've created that no one else around has. That's what it takes to beat so many speeding tickets, and that's why we do it. In this Episode I Talk About: Our successes for the week; A new resource we've got available for people that want to fight their tickets on their own; 3 things we do to increase our chances of success; and Much much more!Right click here to download the MP3 Items Mentioned in this podcast:How to Beat a Speeding Ticket on Your own Questions or Feedback? Beat a Speeding Ticket by Beating the Radar Gun
In this episode of The Ultimate Traffic Lawyer Podcast I talk how to beat a speeding ticket by beating the radar gun (RADAR and LIDAR). One of the things I like to do on our blog and on our podcast is give you an inside look into the work we do for each of our clients. I think it helps you understand the work that goes into every case we do, and it also gives you a little inside information if you ever decide to fight a speeding ticket on your own. This week we're going to talk about one of the ways we beat a speeding ticket that have speed measuring devices as the means of catching you. Contrary to popular belief, you can be a speeding ticket that uses a RADAR or LIDAR gun to determine your speed. In this Episode I Talk About: Our successes for the week; A new resource we've got available for people that want to fight their tickets on their own; A resource the court gives you to make sure the cops' speed measuring devices are kept in good working order (and gets you a dismissal if they aren't); and Much much more!Right click here to download the MP3 Items Mentioned in this podcast:How to Beat a Speeding Ticket on Your own Also, CLICK HERE to give us some love on Twitter! Why You Should Hire a Traffic Lawyer Even in a Tough Court
In this episode of The Ultimate Traffic Lawyer Podcast I talk why it's important to hire a traffic lawyer even if you know the court is a tough one to beat a speeding ticket in. Last week we helped someone with a traffic ticket in a court that is notoriously tough (at least notoriously tough to us). Although we ended up with a successful defense of the ticket, the client was unhappy because we had to exercise his deferral. That wasn't the part that led to this podcast. The part that led to this podcast was the client's insinuation that we'd been less than up front with him about the ticket. Basically the client was unhappy because he thought we just went in and did the same thing they could have done. He wondered why he should even hire a traffic lawyer if the court was tough to win in. That feeling sparked this episode, because I think it's an important question for anyone out there considering hiring a traffic attorney. It's important because if you make a hasty decision and don't think the decision all the way through there is a decent chance you could regret that decision for years to come. 3 Times You Don’t Need a Seattle Traffic Attorney
In this episode of The Ultimate Traffic Lawyer Podcast I talk 3 times you don't need a Seattle traffic attorney you help you with your case. I saw someone post on Facebook the other day, a fellow traffic attorney, talking about a ticket they'd gotten dismissed for a client. I was happy for the guy until I realized what kind of ticket it was. Not only was it a ticket that wouldn't affect your insurance, it was a ticket that you can usually take care of by mailing in a document! What Happens in Speeding Ticket Court?
In this episode of The Ultimate Traffic Lawyer Podcast I talk what really happens in speeding ticket court. Everyone has a plan until they get punched in the mouth. You know who's famous quote that is? Mike Tyson. That quote doesn't just apply to boxing though. It applies to traffic ticket defense too. Because when you go into speeding ticket court you've got to be prepared for when you get punched in the face. If you aren't ready it's not going to end well. This weeks podcast is all about navigating the court when you fight your ticket. Our Speeding Ticket Process
In this episode of The Ultimate Traffic Lawyer Podcast I talk the Emerald City Traffic Defense speeding ticket process. For most people, the work a traffic lawyer does for them is mostly unknown. For example, with our firm, someone typically calls us, signs up, and we take care of everything from there. When the process is complete, we let them know how everything worked out (usually it's great news!). But for this week's podcast I wanted to pull back the curtain a little bit and let you see what we actually do for each our tickets. It's why we charge the fee that we do (the value we provide is enormous) and it's why we have the success that we do. In this Episode I Talk About: Our week in review, including the outcomes of the hearings we had last week; Our speeding ticket process, from start to finish; How we get the information we need to beat your speeding ticket; What we look for when analyzing a ticket; What really happens when we go to court; and Much much more!Right click here to download the MP3 Items Mentioned in this podcast: No links to hand out! Why Minor Errors Won’t Beat Your Speeding Ticket
In this episode of The Ultimate Traffic Lawyer Podcast I talk about why minor errors won't necessarily help you beat your speeding ticket. A frequent question I get from people who've gotten a speeding ticket and are thinking of fighting it on their own is, "I see a small error on the ticket. I can win with that, right?" The true answer is "it depends," but in most cases the answer is no, minor errors won't beat your speeding ticket. In today's podcast I explain why you can't beat your speeding ticket with only a minor error. In this Episode I Talk About: Ways the ticket can beat minor errors on the traffic ticket; How the judge can take care of minor errors on a speeding ticket; How the prosecutor can take care of minor errors on a speeding ticket; and How you can take care of minor errors on a speeding ticket. How to Beat a Negligent Driving Second Degree Ticket
In this episode of The Ultimate Traffic Lawyer Podcast I talk about how to beat a negligent driving 2nd degree ticket (otherwise known as a "neg 2"). Camera Tickets and the “I’m Not the Driver” Defense
