Why Words Matter, Legally
Crystal clear clarity is a personal value of mine. For me, clarity comes when I speak and I believe that words are so important. Words help us gain an understanding on what it is we need to do and where we need to focus. They are also extremely important when it comes to your legal documents so today I’m talking about why words matter, legally.  Words can mean different things to different people, which is why it’s vital that your legal documents are clear, concise and represent your business and your offerings accurately. In this episode, I outline some of the important aspects to consider when it comes to the words you use in your legal documents and how a poor choice of words, or words that are too vague, can potentially wind you up in an expensive legal battle.  I share some examples of how unclear wording in legal documents can cause a dispute, particularly when it comes to payment terms. As a business owner, one of the last things you want to do is end up in court because the wording in your legal documents wasn’t quite right. Cease and Desist: Before You Infringe on Someone Else's Trademark
This time of year can be really exciting for business owners. It’s a time for new ideas, a renewed sense of drive, and a reinvigoration of energy. We see businesses launching new offerings and services, new memberships presented and courses launched. You name it, we’re seeing it. In today’s episode, I want to talk to you about the issue of infringing trademarks and how it can be avoided by putting the right processes in place. While I have touched on trademarking previously, there is just so much to unpack on this topic that I want to dig further into what it means and how you can protect yourself as a business owner. As I see more and more people seeking advice on cease and desist letters and instances of trademark infringement, I want you to think about the procedures you have in place for these scenarios.  Without thorough preparation, there is a real risk that you might infringe on somebody else’s trade and be asked to stop trading yourself. What It's Like Working With Me - with Erika Cramer
I know that a lot of business owners are interested to know what it’s really like working with me. So today I’m joined by a beautiful client of mine who doesn't hold back and tells it how it is. Who better to share an honest review of what it’s like working with me than Erika Cramer, the Queen of Confidence.  Erika is a confidence coach, business mentor, author, speaker and passionate about empowering women to be all they can be. In this episode, Erika shares her experience working with me from one woman in business to another.  Prior to working with me, Erika had experience with another lawyer but she shares how it was purely transactional, as opposed to a collaborative relationship. She shares how working with me made her feel listened to and nurtured in a way that wouldn’t be expected from a lawyer.  Many business owners put off doing their legals until it’s too late. Let's Get Organised: How I (an organisation savant) prepare for smooth sailing
Sometimes we can feel like we’re running around chasing our own tails. We start our work days trying to get a handle on all the emails, the schedule and team queries. It can feel like we’ve started the day in a very reactive mode. There can be a number of reasons why we’re feeling reactive instead of proactive, but one of the biggest issues that we can have as small business owners is a lack of organisation. I am personally quite obsessed with planning and finding ways to improve my productivity, and thought it would be helpful if I shared three tips to improve your organisational skills on the podcast today. Firstly, I discuss the importance of planning for the next day the night before, in order to avoid any last-minute stress or worries about forgetting something important.  Secondly, I talk about the importance of using a workflow management system in order to keep track of tasks and projects. Lastly, I discuss the importance of having a morning routine in order to start the day off in a calm and focused manner. Mind Over Matter: Preparing for the year ahead. Do we need to check our ego?
There is nothing better than the promise of a fresh, new year.  I personally love this time as it prompts me to reflect, reassess and look at what I want my business to look like moving into the new year.  I know that a lot of business owners also like to reflect at this time of year, and I wanted to take the opportunity to talk about a common trap I see small business owners fall into, and that is making decisions from your ego. During this period of reflection, we tend to look around at what others are doing in business and feel as if we don’t measure up. We look at others and feel like we should be further along and we can start to feel bad about ourselves. This is often our ego taking over and it causes us to make decisions out of alignment with our true purpose. It's easy to get distracted by other people's successes or social media feeds that make them out to be more than they may actually be. We can fall into the trap of thinking that the same success should apply to us when we haven’t really assessed what our business actually needs, and what we need to be focusing on for ourselves. So as we move into a new year, I want you to take some time to evaluate how your own ego is driving your decisions and actions. Ask yourself these questions: Is this decision in alignment with my personal goals?  Will this help me reach my desired outcome in business?  So often our egos will drive us down the wrong path but acknowledging its presence and its influence can help keep us on track with where we want to go in our businesses.  Find a way to block out the noise for yourself, and keep the focus on your own achievements. Year In Review: Leaps, Bounds & Learnings from 2022
We are at that time of the year where, hopefully, you’re not focused on moving the needle in your business but taking some well-deserved time off. This episode offers some light discussion and inspiration for when you’re enjoying your downtime, to reflect on the year. I find this time of the year really valuable to pause and reflect on business and life in general. This feels vital for me to prepare and plan for the year ahead. Part of the process is reflecting on what worked and what didn’t. I share with you what I’ve identified as my low point and my high point of the year. My biggest challenge for the year has turned into my biggest learning. I explain how, with the right people around me - my bookkeeper, accountant and business strategist - I was able to take action to turn around a difficult situation. This was a powerful lesson and it’s positioned me really well moving forward into 2023. The lessons here have heavily factored into my 2023 planning. The clarity feels priceless. I also share my high points of the year, including the ability to offer pro bono work, some incredible business growth and the ways I’ve been able to prioritise myself. In the past 12 months, I have dived into Human Design - I appreciate it so much because it’s enabled me to take action in areas of my life and business that have proven to be game-changing. Time to take stock, & think 2023 strategy
This week I want to talk about strategy and planning for 2023. I love a good strategy. And there is no substitute for preparation. This applies to so many aspects of life and certainly to many parts of running a business. This time of year can be a really wonderful opportunity to pause, take stock and reflect on the year that’s been. This allows us to uncover the lessons from the year and understand where the real value was in our business journey across the year. My starting place for planning is always looking back, being mindful and identifying what worked and what didn’t work. Taking a gentle and compassionate look at the year that’s been can be really empowering. I really love the start of anything new. It feels like a clean slate. I share the five questions to ask yourself when you’re reflecting on the year that has been and put your strategy together for 2023. This helps me understand the lessons from the year, including where I’ve strayed from my ‘why’. Nothing stays the same forever. When I inject fluidity into my plan, I find it really refreshing and empowering. It gives me permission, to be honest, and understand what’s really going on in my business, I reflect without judgement. I also explain how I do my planning in quarters and the software I use. I share a declaration that has been really powerful in my planning and strategy development: I don’t do overwhelm. It’s been a game-changer. Having fierce boundaries has helped make sure overwhelm is no longer part of my life. We can’t achieve our goals and objectives if we don’t know what they are and we don’t have a map or a pathway to get there. When Things Don't Go According To Plan In Your Business
At this time of year, I always take the time to pause and reflect on what has been. Is business everything I thought it would be? Have things gone according to plan? We place so much focus on success and achieving our goals that often when things don’t go how we hoped they would, we perceive this as failure. But the truth is, failure is not the opposite of success. Failure is a vital part of success.  In this episode, I want to encourage you to take a moment to reflect on 2022, take stock and commend yourself for your incredible efforts this year. The business journey is not linear, which is why it’s so important that we embrace change, and recognise that success is when we are being the best version of ourselves, despite the circumstances.  I talk about remembering your “why” in business. Why do you do what you do? Because when you’re crystal clear on your why and use it as an anchor in your business journey, it’s much easier to navigate the ups and downs. Coming back to your values and purpose will help you to keep your head up when things don’t go according to plan.  So, while you’re reflecting on the year that’s been, if you feel like things haven’t gone according to plan, remember to pause and celebrate your wins. You DO Need Insurance, Here's Why, with Laura Meyer
This is the episode that so many of you have been waiting for. I talk a lot in my business about risk mitigation and my approach is that prevention is better than cure. I’m joined today by someone who shares the same view. Laura Meyer from Meyer Insure is an insurance broker who not only supports me in my business and personal life insurance policies but also looks after many of my clients. That is to say, her insurance advice comes very highly regarded. In the episode today, Laura takes us on a deep dive into insurance and answers all of the questions that I know have been plaguing many of you around policies, cover and risk mitigation for small businesses. In our conversation, Laura explains where you should start as a business owner regarding insurance policies and how talking to a broker is the easiest way to get tailored advice that’s right for your business. We discuss the fact that off-the-shelf products do little to consider your business, exposure and risk profile. If you haven't spoken to a broker to tailor your insurance policy, having a Certificate of Currency does not mean you are covered for everything you may need to be. Laura shares that the biggest misconception about insurance is that one size fits all, and that can be a mistake that is fatal for a business. Laura talks us through both professional indemnity and public liability insurance and the benefits of packaging insurance into ‘business pack’ insurance policies. We also discuss insurance for retreats, worker’s compensation, cyber insurance and whether it’s possible to be over-insured. Insurance is one of those things that we don’t love to think about (similar to legal documents) but is vitally important to get right. You Shouldn't Work All The Time
This time of year is a great opportunity to think about time off over the Christmas and New Year period. I no longer subscribe to the hustle culture or the belief that we need to be doing all the time.  I learnt the hard way that working and being on all the time is a surefire way to burnout.  In this episode, I take you through the reasons why taking time off not only benefits your health and well being, but will greatly benefit your business as well. Not having enough time out ultimately reduces profitability and increases mistakes. You lack clarity and sharp focus. It was not until I stepped away that I experienced what it was like to have space in my life. I also share the magic that I’ve discovered that lies in human design - it gives you permission to be you. I explain how understanding which formula applies to you, allows you to get the best out of your days and yourself. We constantly put pressure on ourselves to be on all the time and see taking a break as a luxury. However, that approach doesn’t serve us or our business. No one needs to be working all the time. It didn’t occur to me that there was another way, and now that I have experienced this, I like to share it with as many business owners as I can to offer my perspective and experience. I encourage you to think about the ways you can take a positive, guilt-free break this Christmas and New year period.

Your Business Isn't a Template, Experts Shouldn't Treat It Like One
No two businesses are the same, which is why every expert who supports your business should treat it as such. In this episode, I’m talking about what it is you can and should expect from experts and what is simply not okay.  Far too often I’m approached by new clients who have had terrible experiences with lawyers who left them high and dry by using templates. By not tailoring their legal documents to their specific needs, these business owners were left overwhelmed, confused and wide open to claims with no leg to stand on. In my view, it’s incumbent on experts to do everything they can to support business owners and not take shortcuts. This includes lawyers, accountants, bookkeepers and every expert who supports you so that you can stay in your zone of genius.   In this episode, I talk about the fact that over half of small businesses in Australia fail, the reasons behind this and why it’s vital for experts to be supporting business owners in a bespoke way. Many business owners purchase legal templates but taking this type of financial shortcut will only cost you more in the long run.  As a business owner, you have the right to ask questions from experts and be given answers so that you understand what you need to do and why. Why I don't do Affiliate Marketing
Today's episode is all about a topic that seems to be everywhere at the moment - affiliate marketing. This is a really important topic for small business owners - you need to be aware of both the risks and rewards of affiliate marketing, and what you need to consider before agreeing to participate in it, or use it to promote your business. First up - what is it? Affiliate marking, also known as influence marketing, is when you agree to be an affiliate for someone’s service or product and you promote it, in return for a reward. I define the ways it can occur and why it’s done. Working out whether you want to do affiliate marketing needs to come back to your why in your business. If you’re comfortable that they’re aligned then go you! There is no right or wrong here. I share the reasons why I don’t participate in affiliate marking, and how my business values have informed this decision. Importantly, if you do decide to proceed with affiliate marketing, you need to make sure that expectations and payment terms are crystal clear. If you’re entering into this kind of arrangement in the hope of expanding your business and network, you need to be aware that you risk souring business relationships if arrangements are not clear. I support my clients to grow in a long-term, positive and sustainable way in their businesses and knowing what affiliate marking is all about before you dive in is incredibly important. How to build an All-Star team
We inevitably reach a point in our business where we consider growing our team. That could be outsourcing to a contractor, or bringing in employees. This is often a difficult step - you’ve worked hard to get to where you are and the people you bring in need to align with your business so that it grows the way you want it to. In this episode, I share the key focus areas to set you up for success to build that all-star team for your business. The first of these is getting crystal clear clarity on what it is you want and need in the role. To set your team up for success, you need to take the time to get really clear on exactly what you need the person to do. Secondly, you need to be clear on what your dealbreakers are - what are your hell nos? I explain the difference between flexibility and compromise, which is important to understand when you’re applying this principle. You also need to know how performance will be measured, how you will give feedback and how you will conduct reviews. What will your key performance indicators (KPIs) be? If you don’t have KPIs, it can be very difficult to measure success. Transparency is key when you’re looking to bring someone in to elevate your business and support its continuous growth.  And in order to be transparent in a meaningful way, we need to plan. Approaching building your all-star team in this way means you’re protecting your business, complying with your legal obligations and you’re setting yourself up for success.  Take the time to jot down and work through these steps when you are looking to hire. Don’t throw your family home out with the business-water

Don’t be Optus. What you need to know about Privacy rules in your business
As you probably know, Optus recently experienced a data breach that affected millions of customers. As a result, business owners are on high alert, wondering if their data is at risk. It's important to understand that having a data breach is not necessarily a breach of privacy laws. However, Optus now needs to prove that all of the steps they had in place to protect data were reasonable. This is a high standard, especially for a large company like Optus.  In this episode, I’m talking about what you need to know about privacy rules in your business, from a legal perspective and in order to build trust with your customers.  As a business owner, you need to be able to establish that you have taken reasonable steps to protect the data you hold. This means having a privacy policy in place that complies with the Privacy Act and having measures in place to safeguard your data.  I have been talking about the importance of privacy policies since the inception of this podcast, and it’s my view that every small business should have one. The Optus fiasco has taught us that we can't just stick our heads in the sand and hope that nothing happens to our data. Let's talk about DIY Templates
In today’s episode, I dive into a topic I am asked about a lot - DIY legal documents. Are templates any good for legal documents? People often turn to DIY spontaneously, because they don’t know how to approach getting professional help, they perceive it to be cheaper, or they don’t care enough to put time and money into it. These are certainly not the reasons you should turn to DIY for your legal documents. I explore the reasons why. Ultimately, your legal documents make up a significant part of your business’s risk mitigation strategy. I explain how not being across what you need to have in place and not being fully supported in how to implement and execute your legals, sends a clear message to your clients. I also discuss the risk it exposes you to. The way we deliver our genius to our clients is different. The way we operate internally is different. Accordingly, legal documents shouldn’t be cookie-cutter or copy-and-paste jobs. There really is no substitute for properly prepared and tailored business legals that work for you and your business. However, it’s never too late to bring this to the top of your priorities list and take action. There is no judgement here. Why I Hate Calling Myself A Lawyer
I’m thrilled to be bringing you the first episode in Season 7 and I’m sharing something I’ve wanted to talk about for a long time. In this episode, I’m talking about why I genuinely hate calling myself a lawyer, and I don’t say that lightly.  The word ‘lawyer’ usually has some very negative connotations attached. From working in the industry for 20 years, I absolutely understand why a lot of people feel so strongly against lawyers and the attitudes they commonly hold. In fact, I rarely associate with lawyers outside of work! In this episode, I share my journey in the industry and why I chose to step away from the traditional way of practicing law to start my own firm where my focus is to educate and empower my clients in a simple, honest and practical way.   When I first started practicing law, I wanted to change the world one client at a time. I quickly realised that if I wanted to be successful, I needed to commit my entire existence to work.  According to industry expectations, I reached success and I talk about how doing so led me to become stressed, overworked and overweight. I share more of this journey and how my perspective completely changed after the birth of my son, helping me discover what really matters in life and how I wanted to live it. I’m so excited that I get to bring these episodes to you and work with my clients in a way that genuinely helps them. What it's like working with me - with Allison Brown
Today’s episode is a little bit different - I am joined by one of my amazing clients Allison Brown from Fudge Gifts and Lifestyle, which she runs with her husband. I talk a lot on the podcast about all the things we do as business lawyers and the advice and tips I’ve got for business owners. So I’m really excited to share with you today what it’s actually like to work with me, straight from one of my clients. Allison really had no idea why she was calling me or what she needed when she first called me, As I say - you don't know what you don't know. We really connected and a week later I got to work getting all of Allison’s legal documents sorted - starting with terms and conditions for their website, as well as employment contracts for all their staff.
